These terms are the agreement between you and DIVEX S.R.L. for using the Duvion app and its services ("Duvion"). By using Duvion, you accept them. How we handle your data is explained in our Privacy Policy.
Who we are
Duvion is published by DIVEX S.R.L., Splaiul Independenței 202B, Room 42, Sector 6, Bucharest 060023, Romania, VAT number RO50207739 ("we"). You can reach us at support@duvion.com.
What Duvion does
Duvion is a personal stylist on your phone. It checks an outfit from a mirror photo, suggests outfits from the clothes you own, plans what to pack for a trip, tells you whether a piece from a shop suits your wardrobe, answers your style questions and, if you ask, finds your colour palette from a selfie. Suggestions are written by an AI model.
Who can use Duvion
You must be at least 16 years old. If you are under 18, you need the agreement of a parent or guardian. Duvion is for your personal use, not for commercial purposes.
Your account
You can use Duvion as a guest or with an account (an email address with a one-time code, Sign in with Apple or Sign in with Google). Keep access to your email and sign-in methods safe: what happens in your account is your responsibility. Guest data is deleted after 30 days without opening the app, as our Privacy Policy explains, so create an account if you want to keep your wardrobe and outfits.
Duvion Plus
- Plans. Duvion Plus is an auto-renewing subscription, sold through the App Store on iPhone and Google Play on Android: yearly, weekly, or Duo (yearly, for two people). The app shows the price, the billing period and what's included before you buy.
- Free trial. The yearly and Duo plans start with 7 free days where offered. Unless you cancel before the trial ends, the subscription starts and the store charges you. On the App Store, cancel at least 24 hours before the end of the trial.
- Renewal and cancelling. The subscription renews automatically at the end of each period until you cancel it in your App Store account settings or in Google Play → Payments & subscriptions. On the App Store, cancel at least 24 hours before the period ends. Deleting the app or your Duvion account doesn't cancel the subscription.
- Payment and refunds. Apple or Google takes the payment and handles billing, renewals and refunds under its own terms. We don't see your payment details and can't issue refunds ourselves: ask Apple or Google.
- Price changes. If the price changes, the store tells you in advance, as its rules require.
- Fair use. Duvion Plus has daily limits, for example on outfit checks and stylist requests, shown in the app. They keep Duvion fast and fair for everyone. We may adjust them, but not in a way that takes away the main features of a period you have already paid for.
- Your consumer rights. If you are a consumer in the European Union, you keep the rights the law gives you, including any right of withdrawal. Apple and Google handle these requests for purchases made through them.
Duo
- Duo is one yearly subscription for two people, each with their own account. The person who buys it invites the other with a code. While you are linked and the subscription is active, both of you have Duvion Plus.
- Each of you keeps your own data. Nothing is shared until you turn sharing on or send a question, and you can turn sharing off at any time.
- Either of you can end the link at any time. The other person's Duvion Plus from Duo then ends, and so does access to anything you shared. It also ends when the buyer's subscription ends.
- Invite only someone who wants to join, and treat each other with respect.
Your photos and content
- You keep all rights to the photos, notes, wardrobe and other content you add to Duvion.
- You allow us to store and process that content, and to send it to the providers named in our Privacy Policy, only to run Duvion for you and only for as long as the Privacy Policy says. We don't use your photos to train AI models or for advertising.
- Add only photos you have the right to use. Add photos of other people only with their permission, and never sexual or intimate images.
- Don't add content that is illegal, hateful or harassing, or that breaks someone else's rights.
Fair play
Don't:
- break the law or anyone's rights while using Duvion;
- try to get around limits, payments or security, or access other people's data;
- overload Duvion, scrape it with automated tools, or copy, decompile or reverse-engineer the app, except where the law allows it;
- resell Duvion or use it for commercial purposes;
- use Duvion, including Duo, to pressure, harass or monitor anyone.
If you seriously or repeatedly break these terms, we may limit or close your access. We'll tell you why, unless the law doesn't allow it.
AI suggestions
- Suggestions, comparisons, palettes and stylist answers are produced automatically by an AI model. They are style advice, not facts or professional advice.
- They can be wrong: the AI can misread a colour, a piece or an occasion. Colours look different on screens and in different light, and the colour palette is an estimate.
- Weather comes from forecasts, which can change.
- When Duvion checks a piece from a shop, it doesn't sell it and isn't part of that shop. Price, size, availability, delivery and returns are between you and the shop.
- What you wear and what you buy is always your decision.
Our app and brand
The Duvion app, its design, texts, name and logo belong to DIVEX S.R.L. We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, under these terms and the rules of the store you got it from. These terms don't give you any other rights to Duvion.
Availability and changes to Duvion
We work to keep Duvion running well, but we can't promise it will always be available or free of errors: maintenance, updates and outages at our providers can interrupt it. We may change, add or remove features. If a change significantly reduces Duvion Plus during a period you have paid for, we'll tell you in the app before it applies, and you can cancel. If we ever stop offering Duvion, we'll tell you at least 30 days before and you'll be able to download your data.
Liability
Nothing in these terms limits our liability where the law doesn't allow it, in particular for death or personal injury caused by negligence, for fraud, intent or gross negligence, or your legal rights as a consumer, such as the legal guarantee that digital content and services conform to the contract.
To the extent the law allows, we are not liable for indirect losses, or for decisions you make based on a suggestion, such as a purchase, and our total liability to you is limited to what you paid for Duvion Plus in the 12 months before the claim.
App Store and Google Play
If you got Duvion from the App Store:
- these terms are between you and us, not Apple, and we, not Apple, are responsible for Duvion and its content;
- Apple has no obligation to provide maintenance or support for Duvion;
- if Duvion fails to conform to an applicable warranty, you can tell Apple, and Apple will refund the price you paid for it, if any; to the extent the law allows, Apple has no other warranty obligation for Duvion;
- Apple is not responsible for any claims about Duvion, including product liability claims, claims that Duvion doesn't meet a legal or regulatory requirement, consumer protection claims, or claims that Duvion infringes someone's intellectual property; we handle them;
- you confirm that you are not in a country under a US Government embargo or on a US Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you;
- Apple's Licensed Application End User License Agreement also applies to your use of the app; where it conflicts with these terms, these terms apply to the extent the law and Apple's rules allow.
If you got Duvion from Google Play, the Google Play Terms of Service also apply to your purchases.
Ending
You can stop using Duvion at any time and delete your account in the app (Profile → Privacy) or at https://api.duvion.com/account/delete. Remember to cancel the subscription in the App Store or Google Play as well. The parts of these terms that by their nature should continue, such as liability, stay in force after you stop using Duvion.
Changes to these terms
We may update these terms, for example when Duvion changes or the law requires it. If a change matters, we'll tell you in the app before it applies. If you don't agree with it, you can stop using Duvion and cancel your subscription. The date at the top always shows the current version.
Law and disputes
These terms are governed by Romanian law. If you are a consumer living in another country of the European Union, you also keep the protection of the mandatory rules of the law of your country and can bring a claim before its courts.
If something goes wrong, write to us first at support@duvion.com: we answer within 30 days and will try to sort it out. Consumers in Romania can also turn to the National Authority for Consumer Protection (ANPC, www.anpc.ro).
